Terms of Service

1. These terms

These Terms of Service are an agreement between you and:

They govern your use of the QiraPro website at qirapro.com and the QiraPro mobile app (together, "the platform"). By creating an account, sending a booking request, or otherwise using the platform, you accept these terms. If you do not accept them, please do not use the platform.

In these terms, "QiraPro", "we", "us" and "our" mean the company above; "you" means the person using the platform; and a "rental company" means an independent car rental business that lists its cars on the platform.

2. What QiraPro is — and what it is not

QiraPro is a marketplace. We show you cars offered by independent rental companies, let you compare them, send a booking request, and message the company directly.

We are not a car rental company. We do not own, maintain, insure or hand over any vehicle. We are not a party to your rental.

Your rental contract is with the rental company, not with us. That company decides its prices, its conditions, its insurance and deposit requirements, its fuel and mileage rules, and who it will rent to. It is responsible for the vehicle, for its roadworthiness, for holding the licences and insurance the law requires, and for performing the rental. Any rental agreement you sign at pickup is between you and that company, and it — not this document — governs the rental itself.

We do not take payment from you. No money for a rental passes through QiraPro. See section 7.

3. Who may use the platform

You may create an account and book only if:

  • you are at least 18 years old;
  • you can enter into a binding contract;
  • you hold a valid driving licence accepted by the rental company for the vehicle you book; and
  • your account has not previously been suspended by us.

Rental companies apply their own further requirements — a minimum age, a minimum time since your licence was issued, a valid identity document, a security deposit. Meeting our requirements does not mean a company must rent to you.

4. Your account

You must give accurate information and keep it up to date. You must confirm your email address before you can send a booking request; until you do, you can browse and search but not book.

Your account is personal to you. Keep your password secret, do not let anyone else use your account, and tell us immediately at [CONTACT EMAIL] if you think someone else has access to it. You are responsible for what happens under your account.

You can see the devices your account is signed in on in your account settings, and sign any of them out.

You may close your account at any time. We may suspend or close an account under section 17.

5. Prices and what they mean

Prices are set by the rental company, not by us, and are shown in euro (€).

  • The daily price may change with the length of the rental: longer rentals can be charged at a weekly or monthly rate.
  • A company may set a special price for particular dates, for example a summer season.
  • A company may publish an offer — a percentage off, applied when your pickup day falls inside the offer period. Only one offer applies to a booking; where more than one could apply, you get the largest. An offer applies to the car, not to add-ons.
  • Add-ons you select are added to the total.
  • Some cars are marked as having a negotiable price. For these, the figure shown is indicative and the rental company sets the final price when it confirms your booking. You will see that final price before the rental, and you can cancel if you do not accept it.

The price you see on the car page is calculated by our server for the exact dates and add-ons you chose, and it is the same calculation used when your booking is created. Unless the car's price is negotiable, that is the price recorded on your booking.

The price covers the rental as described on the car's page. It does not include anything the rental company charges you separately at pickup or return — fuel, a security deposit, extra mileage, additional drivers, late return, cleaning, traffic fines, tolls, or damage not covered by the company's insurance. Ask the company before you collect the car if you are unsure.

6. Making a booking

When you send a booking request, you choose the car, the pickup location, the dates and any add-ons, and you tick that you accept these terms. We record which version of these terms you accepted, and when.

A rental covers the period from the pickup date up to, but not including, the return date — the car is free again on the return date.

What happens next depends on the car:

  • Instant booking. Some cars are confirmed immediately. The booking is confirmed as soon as you send it.
  • On request. Otherwise, the booking is pending until the rental company confirms it. A pending booking is not a guarantee that the car will be available to you.

The rental company may confirm or decline. If a pending request is still unanswered by the day after your pickup date, it expires automatically and is marked cancelled, and we tell you both. A confirmed rental that has run its course is marked completed automatically the day after the return date, unless the company has already closed it.

A booking is between you and the rental company. We pass it on, keep the record, and give you both a place to talk about it.

7. Payment

Rentals on QiraPro are paid in cash, directly to the rental company, normally when you collect the car. QiraPro does not process card payments, does not hold your money, and charges you nothing for using the platform.

It follows that:

  • we do not issue invoices or receipts for a rental — the rental company does;
  • we do not take, hold or refund deposits;
  • we cannot refund you, because we never received payment. Any refund is a matter between you and the rental company.

A security deposit, if the company requires one, is shown on your booking and is handled entirely by that company under its own conditions.

8. Changing and cancelling a booking

If you cancel

You can cancel a pending or confirmed booking yourself, free of charge, until the day before your pickup date. After that, the cancel button is no longer available and you must message the rental company through the platform, which will apply its own cancellation conditions.

Cancelling on the platform tells the rental company. It does not, by itself, release you from any condition the rental company has told you about or that you agreed with it separately.

If you need to change dates or details

There is no change button. Message the rental company, or cancel within the window above and book again.

If the rental company cancels

A rental company can cancel a pending or confirmed booking. We will notify you by email and in the app. We are not responsible for a company's cancellation and we do not owe you compensation for one, but please tell us at [CONTACT EMAIL] if it keeps happening — we take it into account when deciding whether a company stays on the platform.

9. Collecting the car

Bring a valid driving licence and an identity document. The rental company will check them and may refuse to hand over the car if its requirements are not met — in which case you may lose the booking.

At pickup you deal directly with the rental company: its rental agreement, its vehicle condition report, its insurance terms, its deposit, its fuel policy. Read them before you sign. Anything that goes wrong during the rental — damage, breakdown, an accident, a fine, a late return, a dispute about the deposit — is between you and that company, under the contract you signed with it. We can help you reach the company through the platform, but we cannot decide the dispute.

10. Reviews

After a rental is completed you can leave one rating and an optional comment. It is recorded for both the car and the rental company, and is published with your name.

When you write a review you must describe your genuine experience. You must not post anything untrue, abusive, discriminatory, obscene, or that identifies another person; and you must not write a review in exchange for payment or a benefit, or about a business you are connected with.

We may remove a review that breaks these rules or the law. We do not remove a review simply because a rental company dislikes it, and we never edit the substance of what you wrote. We do not invent or adjust ratings.

11. Messages and conduct

The messaging feature exists so that you and a rental company can arrange a rental, and so that you can reach QiraPro support.

You must not use it to send unlawful, abusive, threatening, discriminatory or deceptive content, to advertise, to send bulk or unsolicited messages, or to try to move a booking off the platform in order to avoid these terms.

Support conversations are with QiraPro. Conversations with a rental company are with that company; we are not part of them, although we can access them where we need to investigate a report of abuse or resolve a complaint.

12. Acceptable use of the platform

You must not:

  • use the platform for anything unlawful, or in a way that breaches these terms;
  • create an account for someone else without their permission, impersonate anyone, or use a false identity;
  • make booking requests you do not intend to honour, or book to block a competitor's availability;
  • scrape, crawl, harvest or bulk-copy content, listings, prices or personal data from the platform, or use an automated system on it beyond a normal browser or our app;
  • reverse engineer, decompile, interfere with or attempt to gain unauthorised access to any part of the platform, its accounts or its infrastructure;
  • introduce malware, or attempt to disrupt or overload the service;
  • resell, frame or redistribute the platform or its content without our written permission.

13. Content and intellectual property

The platform, its software, design, text and branding belong to us or our licensors. You may use them only to use the service as intended.

Photographs, descriptions, prices and other content about a car or a company are provided by that rental company. It is responsible for them and warrants that it has the right to publish them. We do not verify each listing, though we may remove content that breaks these terms or the law.

When you post a review or send a message, you keep your rights in it and give us a non-exclusive, royalty-free licence to host, store, display and distribute it as part of running the platform — for a review, including publishing it on the relevant car and company pages.

14. Terms for rental companies

This section applies in addition to the rest of these terms if you list cars on QiraPro.

Joining

You register your business, and we review it before your listings become public. We may decline an application. You confirm that you are a lawfully registered business entitled to rent vehicles in Kosovo, and that the person accepting these terms may bind that business.

Staff accounts for your business are created by invitation only. You are responsible for who you invite and for what they do in the dashboard.

Your obligations

  • Hold what the law requires: business registration, any licence or permit for vehicle rental, valid insurance for every listed vehicle, and valid roadworthiness inspection.
  • List accurately: the car, its condition, its equipment, its photographs and its price must be truthful and current. Remove or deactivate a car you cannot rent out.
  • Set at least one pickup location. Until you do, your cars cannot be booked and do not appear in location searches.
  • Answer booking requests promptly, and honour those you confirm. Repeatedly cancelling confirmed bookings, or not turning up, is a serious breach.
  • Charge what was agreed. The price on a confirmed booking is the price of the rental, except for a car marked as negotiable, where the final price you set on confirmation applies, and except for the extras described in section 5, which you must tell the customer about before pickup.
  • Deal with your customers fairly and lawfully, including under the consumer protection law of Kosovo.
  • Protect personal data. You are an independent controller of the customer data you receive through QiraPro. Use it only to perform and administer that rental, keep it secure, and comply with data protection law. Do not use it for marketing without a lawful basis, and do not pass it on except as the law allows.
  • Keep your messages and your dashboard content free of the conduct prohibited in sections 11 and 12.

Subscription and fees

Listing on QiraPro is on a monthly subscription. We take no commission on your bookings and no payment from your customers.

  • The monthly fee that applies to your business is the one agreed with you and shown on your account.
  • We may change the fee for future periods by giving you at least [NOTICE PERIOD, e.g. 30 days] written notice. If you do not accept a change, you may cancel before it takes effect.
  • Fees are payable in advance for each period and are [REFUND RULE: non-refundable for a period already started / refundable pro rata].
  • All fees are stated [VAT TREATMENT: excluding / including] VAT.
  • If a subscription is unpaid after [GRACE PERIOD, e.g. 14 days], we may hide your listings until it is settled. Bookings already confirmed remain your responsibility.

You may cancel your subscription at any time, effective at the end of the current period. You must still honour bookings you confirmed before the cancellation.

15. Availability of the platform

We work to keep the platform available, but we provide it "as is" and "as available". We do not promise that it will be uninterrupted or error-free, that a particular car will be available, or that information a rental company publishes is accurate. We may change, suspend or withdraw any part of the service, and we may carry out maintenance.

16. Our responsibility to you

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, or for fraud.

Subject to that, and to the extent the law allows:

  • we are not responsible for the rental itself — the condition, safety, legality or availability of a vehicle, the conduct of a rental company or of a customer, the rental contract you sign, insurance, deposits, damage, accidents, fines, or any loss arising from a rental;
  • we are not liable for indirect or consequential loss, lost profit, lost revenue, lost opportunity, or a ruined journey or holiday;
  • where we are liable, our total liability to you for all claims arising in any 12-month period is limited to [LIABILITY CAP, e.g. €100 for customers, or the subscription fees paid in that period for rental companies].

If you are a consumer, you keep all rights you have under the consumer protection law of Kosovo, and nothing here reduces them.

17. Suspension and termination

We may suspend or close your account, or remove content, if you break these terms or the law, if we reasonably suspect fraud or abuse, or if keeping the account would expose us, a customer or a rental company to harm or legal risk.

Suspension locks the account and signs it out everywhere. Where it is reasonable and lawful to do so, we will tell you why and give you a chance to respond. Bookings and records are retained under our Privacy Policy.

You may stop using the platform at any time. Sections 13, 16, 18 and 19 survive the end of this agreement.

18. Complaints and disputes

If something goes wrong, contact the rental company first through the platform — most problems are settled there.

If your complaint is about QiraPro, or a company will not engage, write to [CONTACT EMAIL] with your booking number. We aim to reply within [RESPONSE TIME, e.g. 5 working days].

If you are a consumer and we cannot resolve it between us, you may take the matter to the consumer protection authority of Kosovo or to the courts.

19. Changes to these terms, governing law, and the rest

Changes. We may update these terms. The date of the current version is shown at the top of this page, and material changes will be announced on the platform before they take effect. Your booking is governed by the version of these terms you accepted when you made it; continuing to use the platform after a change means you accept the new version for anything after it.

Governing law. These terms and any dispute arising from them are governed by the law of the Republic of Kosovo.

Jurisdiction. The competent court in [CITY, e.g. Pristina] has jurisdiction, except that a consumer may also bring proceedings in the court for the place where they live, and may be sued only there.

Severability. If any provision is found invalid, the rest stays in force.

No waiver. If we do not enforce a provision, we do not give up the right to do so later.

Entire agreement. These terms, together with our Privacy Policy and Cookies Policy, are the whole agreement between you and us about the platform. They do not affect your separate contract with a rental company.

Language. These terms are published in Albanian, English and German. If there is a conflict between versions, the [CONTROLLING LANGUAGE, e.g. Albanian] version prevails.
